AI Regulation:  EU AI Act and US AI Bill of Rights to Set Rules

With AI safeguard laws still fluid across the globe, the EU Bloc recently enacted legislation with binding rules for the development of AI technology and the safe use case of AI within cybersecurity. The US could follow with legislation based on the White House Office of Science and Technology’s Blueprint for an AI Bill of Rights, which was created to serve as a guide to protect the American public from AI threats and cybersecurity threats. 

 Even with the ongoing changes in AI safeguard laws, companies should proactively implement governance measures to manage AI keeping the board of directors, general counsel and CEO informed at each stage. Until US AI safeguard legislation is passed, the current EU legislation and US blueprint for an AI safety bill should serve as a framework for implementing AI practices to protect individuals and communities from cybersecurity threats. 

On February 2, 2024, the EU Bloc enacted the AI Act. As reported by Politico.eu, “the law would ban some applications of AI technology, impose strict limits on use cases considered high-risk, and hem in the most advanced software models with obligations of transparency and stress-testing.” 

Currently the White House Office of Science and Technology is recommending the Blueprint for an AI Bill of Rights a guide for US companies, educational institutions, communities, and individuals. 

5 Principles: Blueprint for an AI Bill of Rights 

The US Blueprint for an AI Bill of Rights identifies AI safe use principles and associated practices that should “guide the design, use, and deployment of automated systems to protect the American public in the age of artificial intelligence.”

  2. Algorithmic Discrimination Protections
  3. Data Privacy 
  4. Notice and Explanation  
  5. Human Alternatives Consideration, and Fallback

Some are concerned that if enacted as law, the US Blueprint for an AI Bill of Rights could hinder competition and innovation. However, according to the White House Office of Science and Technology, the Blueprint for an AI Bill of Rights “is a guide for society that protects all people from these [AI] threats—and uses technologies in ways that reinforce our highest value.”
